Can’t we all just get along? Well, in reality, you don’t need to “get along” to settle your case at mediation. What you do need is to be able to look past your complaints about the other side and make smart judgments regarding your finances and your relationship with your children. Whether a single issue custody lawsuit, or a complex divorce, parties with contentious relationships and dynamics usually still reach a full and final settlement agreement at mediation. A good mediator has the expertise and gravitas to assist parties in getting past their inevitable differences and understand how a settlement will better serve them individually and their future household in the long-term.

John Hennan is a licensed mediator in the State of Texas, and is Board Certified in Family Law by the Texas Board of Legal Specialization. John frequently mediates all types of family law cases seeking resolution.
Because we have what we refer to as “freedom of contract,” a mediated settlement agreement often has the additional advantage of being custom-tailored to the parties’ desires and concerns, in a way that a judge-rendered court order simply does not. It is also often a great way to avoid both the financial and emotion toll of prolonged litigation.
A good mediator can reason with parties about the realities of litigation, risks, and the benefits of moving forward, while maintaining each party’s trust as an objective settlement facilitator. It’s important to be straightforward and direct, but also caring and attentive to each party’s concerns, feelings and goals. A good attorney representing their clients at mediation knows how to communicate well with the mediator, how to present their client’s case and concerns in a digestible and credible way, and how to advise their client and provide support when it comes time to assess options of settling or moving forward with litigation.
